They don't have to do that, but many people do as a courtesy and because they're more interested in protecting their material than retribution.
Anything that anyone creates is de facto intellectual property and copyrighted, and you can be legally prosecuted for using or modifying it if they have not given permission to do so. Now, the likelihood of this happening is a different story altogether.

I remember a demesne that spanned the whole of Paavik with the only breakpoint somewhere in Glom (or Seren, that's the problem with guildhopping)-guards or something like that. Old times!

Ok, so, the first demesne size downgrade happened 6/17/2005, the size wasn't mentioned in the announce, and no one on the forums made a post about demesnes for the entire month of June. I think that bit of trivia is lost forever.
